Preserving Evidence is Not America’s Favorite Pastime
Rob Boroff and Phil Nester presented “Preserving Evidence is Not America’s Favorite Pastime,” to the Northeast Ohio Chapter of CLM at their Networking and CLE event at Progressive Field on August 29th. Rob and Phil discussed the importance of electronic data recorders in auto and commercial transportation accidents, responding to document preservation letters, and avoiding spoliation of evidence. Rob is a partner in the Cleveland office of Gallagher Sharp where he focuses his practice on commercial transportation and construction litigation. Rob is national counsel for one of the largest trucking companies in the nation and is part of Gallagher Sharp’s Rapid Response Team that is tasked with immediately responding to accident scenes for the purpose of investigating and evaluating catastrophic losses for his clients. Phil is also part of Gallagher Sharp’s Rapid Response Team, he defends commercial motor carriers and their insurers in claims and lawsuits involving wrongful death, personal injury, and property damage. Prior to joining Gallagher Sharp, Phil was a claims examiner in the insurance industry.
