Gallagher Sharp Attorneys Joe Pappalardo, Phil Nester, Chris Razek, and Paralegal Eileen Gerson were able to recently obtain a favorable verdict in Cuyahoga County (after less than two hours of jury deliberations) for their clients, a Canadian trucking company and truck driver, after a four-day jury trial, for a case involving a commercial truck accident. Joe was retained to take over this case six weeks before the start of the scheduled trial and to try the remaining property damage subrogation case valued at over half a million dollars (about $700,000.00 Canadian).
This was a complicated case for the Gallagher Sharp team from the start, which involved Joe traveling internationally in order take a video deposition from the driver involved in this accident, as the driver was restricted from crossing the US Border due to the accident. The trucking company representative was also prohibited from entering the United States.
The underlying facts arose from a dispute between the defendant and plaintiff (also a Canadian Trucking Company and driver, who died in the accident, as well as their subrogated insurer) over proper usage of express lanes on I-271 in Highland Heights, Ohio, as well as the Ohio Assured Clear Distance Ahead statute.
