Attorney Kim H. Townsend, of Gallo Vitucci Klar LLP, represented Gray Line Bus Company in a case of an alleged bus accident in New York County. She successfully recovered a defense verdict in favor of the bus company.
The alleged accident occurred on June 21, 2013. According to the plaintiff’s account, he was walking toward the South Street Seaport in Manhattan when he was hit by a double-decker bus owned by Gray Line Bus Company. The plaintiff claimed that the impact threw him 10 feet into the air and contributed to injuries in his hips and right shoulder. He alleged that the bus driver and a tour guide provided no assistance to him following the accident; rather, the plaintiff was supposedly only provided with the bus company’s insurance information.
The plaintiff did not visit a hospital until two days after the accident allegedly occurred and was reported to be unscratched and unbruised. He later had bilateral arthroscopic surgeries on his hips and two arthroscopic surgeries on his right shoulder, and demanded $4.8 million to compensate for his medical bills and other damages.
An attendant who was working at the Seaport parking lot when the accident allegedly occurred stated that he did not witness a collision, although he did see the plaintiff on the ground next to a bus. The plaintiff, following the alleged accident, provided the bus driver with a phone number that did not connect to him. Additionally, there was no police report linked to the incident (the plaintiff claimed he did file a report).
The plaintiff had multiple surgeries since the date of the alleged accident and had been deposed several times in that period. The Gallo Vitucci Klar LLP legal team had filed a motion for summary judgment on the basis of liability, which was denied and upheld on appeal. Following 30 minutes of deliberation, a jury ruled in favor of the defense in a liability trial in New York County.
