Summary Judgement Achieved by Attorneys Bryan Schwartz and Krystina Maola in Trip and Fall Case
A New York Presbyterian Hospital employee claimed to have sustained fractured ribs and soft tissue injuries by tripping over a wheelchair lift on an ambulette. The plaintiff claimed that the wheelchair lift was left unattended and “optical confusion” caused her fall.
Attorneys Bryan Schwartz and Krystina Maola argued that the plaintiff should have noticed the wheelchair lift, and that the lift was not hazardous. Rather, the accident was caused by the plaintiff’s own negligence. The claim was dismissed prior to deposition.
Attorney Matthew Levy Obtained Summary Judgement in Injury Case
Attorney Matthew Levy represented a building owner and a manager in an injury case involving a woman who claimed she was injured by a falling tree branch. The plaintiff also sued the City of New York and the New York City Department of Parks and Recreation.
Attorney Levy argued that the building owner and manager are not responsible for maintaining trees, and that doing so was the duty of the New York City Department of Parks and Recreation.
The case resulted in a summary judgment, achieved pre-deposition. The New York City Department of Parks and Recreation was identified as holding exclusive jurisdiction in this case.
